Alfred Kwabena Asiedu, a judge on the Jasikan Circuit Court, has been dismissed from the Judicial Service by Her Ladyship Justice Gertrude Torkornoo, Chief Justice, due to his inappropriate behaviour in a divorce case he decided.
On January 16, Singari Diana Sadia filed a petition with the Chief Justice, charging the judge with impropriety, malicious prosecution, abuse of power, and sexual exploitation.
The petition was then forwarded to the Judiciary Service disciplinary committee, which looked into it and concluded that the judge’s misconduct called for his dismissal.
Thus, the judge has been instructed in writing by the Chief Justice to turn over to the Judicial Secretary all official belongings that are in his custody, such as his official car, dockets, and record books.
I’m writing in regard to the petition that Singari Diana Sadia, dated January 16, 2023, submitted against you alleging misuse of authority, sexual exploitation, malicious prosecution, and improper behaviour.
As required by the Service’s Disciplinary Procedures, you received an invitation to appear before the Judicial Council’s Disciplinary Committee, which was tasked with looking into the accusations made against you.
Following an investigation into the aforementioned matter, the Disciplinary Committee concluded that you had engaged in misconduct as a judge because there was sufficient evidence to suggest that you had an improper relationship with the Petitioner, who was the subject of an ongoing divorce case. Since it was determined that you were the reason behind the Petitioner’s unwarranted arrest and prosecution, the Disciplinary Committee also established the allegations of abuse of power and malicious prosecution against you. As a result, the Disciplinary Committee suggested that you be fired.
The Judicial Council received the report from the Disciplinary Committee after it was submitted, and on October 25, 2023, during its 279th meeting, the Council accepted the report and determined that the actions you had described above qualified as stated misconduct.
Under Article 151 (1) of the 1992 Constitution of Ghana, all members of the Judicial Council present at the said meeting resolved that you should be removed from office for Stated Misbehaviour.
You are therefore removed from Office as a Circuit Court Judge, with immediate effect. You are directed to hand over all official properties in your possession, including your official vehicle, Dockets and Record Books to the Judicial Secretary forthwith.
By a copy of this letter, the Director of Human Resources is requested to ensure that your name is deleted from the payroll of the Service with immediate effect.
