Regarding the anti-LGBTQ+ bill, a private citizen named Paul Boama Sefa has filed a lawsuit against the Speaker of Parliament, Alban Bagbin, and the Attorney General, Godfred Yeboah Dame.
The Speaker and the Attorney General are accused of violating the constitution in their management of the Proper Sexual Human Rights and Ghanaian Family Values Bill, according to Mr. Sefa, a farmer in the Ashanti Region.
Given the Bill’s financial implications, he said that Parliament did not analyze its budgetary impact.
The complainant claims that the Public Financial Management Act, 2026 (Act 921)’s section 100(1), which mandates that the Bill be accompanied by a fiscal impact analysis when the Bill is initially presented before Parliament, was not followed and is still being followed.
He maintains that the Speaker’s plans to break the law are a result of this statutory violation.
Paul Sefa continues to contend that the Speaker of Parliament’s reluctance to enforce the law’s provisions was deliberate given his steadfast commitment to permit the Bill to proceed through the legislative process despite being fully aware of the statutory prerequisites for laying the Bill.
Among other things, he is asking for a court order to stop the Speaker, his deputies, his agents, assigns, and privies from moving forward with any Bill-related processes until the statutory requirements of section 100(1) of the Public Financial Management Act, 2026 (921), are met.
Additionally, before taking any further action regarding the Bill, an order requiring the Speaker, his deputies, his agents, and privies to guarantee compliance with section 100(1) of the Public Financial Management Act, 2016 (Act 921) is needed.
In addition to any other relief the court may consider appropriate, he requests a perpetual injunction prohibiting the defendants from violating the Public Financial Management Act, 2016 (Act 921).
